General Terms and Conditions

  1. Scope of application

These General Terms and Conditions (GTC) apply to all services and products offered by MaiThai-Shop.ch GmbH on its online shop at www.maithai-shop.ch.

  1. Offer and conclusion of contract

The products and services published in the online shop of MaiThai-Shop.ch GmbH are considered offers.

The contract is concluded when the customer orders the products and services using the form provided for this purpose on the Internet. The customer undertakes to provide truthful personal details when ordering the goods.

  1. delivery

Delivery is made throughout Switzerland and the rest of the world. Delivery is usually made by letter post or PostPac Economy 1 - 3 working days after receipt of the order to the specified address. The shipping costs in Switzerland and the Principality of Liechtenstein amount to CHF 0.00. The shipping costs to the rest of the world amount to CHF 20.00. ATTENTION: for deliveries abroad, additional costs of up to 20% of the sales price may be incurred due to customs duties, VAT, etc. Delivery is always uninsured and at the risk of the customer from MaiThai-Shop.ch GmbH, 9063 Stein AR. The risk is transferred to the customer when the goods leave MaiThai-Shop.ch or are handed over to the carrier.

  1. Delay in delivery; cancellation or withdrawal

Orders are binding and the customer is obliged to accept them. If a product or service is not available within the specified period, the customer will be informed. If a product or service is no longer available, the contract shall be cancelled to this extent. If the ordered goods are not delivered within 6 weeks, the customer may set a grace period with the notice that he will refuse to accept the ordered goods after the grace period has expired. The grace period must be at least one month. If delivery is still not made within this grace period, the customer has the right to withdraw from the contract by written declaration after the grace period has expired. Payments already made by the customer shall be refunded in the event of cancellation or withdrawal. Other claims by the customer, in particular claims for damages due to delays in delivery or cancellation, are excluded.

  1. Transport damage

The risk of damage or destruction of the goods is transferred to the customer upon handover by MaiThai-Shop.ch GmbH to the transport company. This also applies if MaiThai-Shop.ch GmbH has assumed the transport costs. Complaints due to transport damage must be made by the customer to the transport company.

  1. Complaints and liability

Complaints must be made in writing by the customer immediately upon receipt of the delivery, but at the latest within one week of receipt of the delivery, insofar as they can be determined by reasonable inspection. In the event of justified complaints, MaiThai-Shop.ch GmbH will make subsequent deliveries of reduced quantities and take back incorrect deliveries. Defective goods can be exchanged at MaiThai-Shop.ch GmbH's discretion or, where reasonable for the customer, a price reduction can be granted. Returns by the customer to MaiThai-Shop.ch GmbH are not possible because the goods are foodstuffs and it is not possible to exchange them for reasons of hygiene.

  1. Terms of payment

Payment is made using one of the payment methods available in the online shop. The conditions of the individual payment methods listed there apply.

  1. Data protection

MaiThai-Shop.ch GmbH uses the personal data provided by customers solely for the purpose of processing the contract and for advertising purposes. No further processing of the personal data provided takes place. MaiThai-Shop.ch GmbH only passes on the personal data provided to it to third parties insofar as this is necessary for the fulfilment of the contract. Beyond this, personal data provided will not be passed on to third parties. The customer agrees that MaiThai-Shop.ch GmbH may collect the personal data provided to it and process it as described above. By placing an order with MaiThai-Shop.ch GmbH, the customer agrees to the data protection policy of MaiThai-Shop.ch GmbH.

  1. Orders from MaiThai-Shop.ch GmbH

The GTC of Swiss Post (available at www.post.ch) also apply to dispatch by post. If the customer is not present, the postman will issue a collection invitation with a seven-day collection period. The consignment can be collected from the relevant post office with the collection invitation or a new delivery date can be agreed with the post office. If the consignment is not collected within the collection period, the goods will be returned. Any resulting additional costs will be charged to the customer. In this case, no refunds will be made for orders that have already been paid for.

  1. Return of goods

Returns, exchanges, etc. are not possible for reasons of hygiene.

  1. Miscellaneous

MaiThai-Shop.ch GmbH reserves the right to amend these General Terms and Conditions at any time and to apply them immediately. The invalidity of individual provisions of these General Terms and Conditions shall not affect the validity of the remaining provisions contained therein. The invalid provision shall be replaced by a new provision that comes as close as possible to the invalid provision in its effect.
